PRIVACY POLICY
This Privacy Policy governs the manner in which Cardinell Enterprises, LLC dba Cortx (“we” or “us”) collects, uses, maintains and discloses information collected from visitors and users (each, a "User") of Perfect Tense™ (the “Services”) or www.perfecttense.com (the "Site")) and persons who communicate with us (e.g., by email or phone).
Every time someone visits or uses the Site or communicates directly with us, we collect various types of “Personal Information” about him or her. “Personal Information” means any information that identifies an individual, directly or indirectly. Examples of Personal Information that is collected by us includes names, addresses, emails, credit card information, phone number, user names, and passwords. The amount and type of Personal Information collected is not the same for everyone, and some of it we do not store. We may collect Personal Information from a User in a variety of ways, including, but not limited to, when the User visits the Site, creates an account to use the Services, or saves text that is processed by the Services. If we do keep any Personal Information, that information is used for the purposes described below. We do not share any Personal Information except as explained in this Privacy Policy. For example, we will never sell Personal Information unless part of the sale of our business.
Information Collected By Us
When you visit the site, we collect information about the device (e.g., computer or cell phone) you use to access the Site, such as its hardware model, operating system, IP address, browser type, add-ons, language, and time zone. If you access the Site from your phone or other mobile device, we may learn your phone number and your location unless a setting in the device prevents the data from being shared with us. We may also collect the time of your visit, the pages you view, any links you select to leave or interact with our Site, and other usage information available through the use of cookies and other tracking technologies (e.g., web beacons (also known as Internet tags, pixel tags, tracking pixels, and clear GIFs)). For example, we collect the URL of the site that you visited immediately before your visit to the Site and the one to which you go next. We also learn your internet service provider and mobile carrier (depending on the device you are using).
If you use any of the Services, we collect the information required for such use. For example, if you register for a free trial, you will be required to provide your name and email address and create a user name and password. If you subscribe to the Services on behalf of your employer (the “Subscriber”), you will be required to set up an account and provide the name of the principal contact for the Subscriber, the name of the Subscriber, the Subscriber’s address, domains, and credit card or other payment information, and user name and password information. We may obtain additional information about the Subscriber, such as address change information, from commercially available sources.
We also collect information about how you use the Services, (e.g., the frequency and the duration of activity). We may also receive information from other companies or third parties about use, such as when a third-party service provider helps us analyze the Services.
We collect information when we engage in communications when we handle inquiries. We store electronic copies of all communications we send or receive (i.e., by email), and we may log notes about phone calls that involve customer service. If we receive a phone call from you, we may then obtain Personal Information from you such as your name, address, and phone number.
THE SERVICES MAY CHANGE OVER TIME OR WE MAY HAVE NEW SERVICES OR PRODUCTS; THEREFORE, YOU SHOULD KEEP IN MIND THAT WE MAY COLLECT NEW OR DIFFERENT TYPES OF INFORMATION IN THE FUTURE. WE WILL UPDATE THIS PRIVACY POLICY ACCORDINGLY, SO BE SURE TO CHECK BACK FROM TIME TO TIME FOR UPDATES.
How Information Is Used By Us
We use Personal Information for the following purposes:
Account Registration; Record/Subscription Management – that is, we keep track of the use of the Services by registered users so that we know how the Services are being used, to troubleshoot or resolve problems with an Account, and to communicate important information about the Services or an Account (e.g., invalid payment). We use Personal Information to bill and collect money owed to us.
Provide Our Services, Run Our Business, and Security – that is, Personal Information is essential to the operation of the Services, measuring our performance, and combatting fraud and protecting the Personal Information (e.g., security tests).
Customer Service and Technical Support – that is, we use Personal Information to communicate about the Services (e.g., features, functionality, and costs) or an Account, respond to inquiries, and analyze and resolve questions or problems users have while trying to interact with the Services. Sometimes, the data used to analyze and resolve general issues with the Services is de-identified.
Communicate About Other Services – that is, we may provide offers for third-party products and services that we think may be of use. Please see below under "Your Choices and Obligations" for options regarding these communications.
Develop New Services and Address Service Issues – that is, from time to time, we may develop new features or functionality, improve the overall quality of the Services, and for address availability issues, including troubleshooting, data analysis, and testing.
Data Retention – that is, in accordance with and as permitted by applicable law and regulations, we will retain Personal Information if necessary to serve the User, to maintain a Subscriber’s account for as long as it is active, or as otherwise needed to operate our business. When an Account is closed, we may continue to communicate with the Subscriber about our Services, important business updates, and products and services of interest (unless the addressee has opted out of receiving marketing communications). We may also continue to use some Personal Information for business purposes, to improve our offerings, or, in some cases, to develop new ones – all of which uses will be in a de-identified manner. We will retain and use Personal Information as required by applicable regulations and our records and information management policies to comply with our legal and reporting obligations, resolve disputes, enforce our agreements, complete any outstanding transactions and for the detection and prevention of fraud.
Legal Interests – that is, we use Personal Information when necessary to bring or defend claims involving the Services, the Site, or our business practices, and to enforce our Terms of Use, a Subscription Agreement (including, but not limited to, an Enterprise Agreement), or applicable law. Personal Information is also used to meet our legal requirements, such as valid court orders, subpoenas, and discovery requests
How Information Is Shared By Us After We Collect It
From time to time, we may share Personal Information as follows:
With Subscribers and Registered Administrators. Each Subscriber and registered administrator have access to the payment method and account information of a Subscriber. We share this information via account access and email.
With Third-Party Service Providers. We share Personal Information with third-party product or service providers who or which help us operate, address service issues with, or enhance the Services, including, but not limited to, website or email server hosts, website designers, programmers, and security vendors. Some third-party applications and services that work with the Services may ask for permission to access your User content or other information about your Account. Those applications will provide you with notice and request your consent in order to obtain such access or information. Please consider your selection of such applications and services, and your permissions, carefully. Our contracts with these third parties require them to maintain the confidentiality of Personal Information, not use Personal Information for purposes other than the product or service they're providing to us, and only to use Personal Information to the extent necessary to their product or performance of their services for us. Oftentimes, Personal Information is de-identified. Moreover, we may share information about Subscribers with third parties, such as advertisers or partners, for research, academic, marketing and/or promotional purposes, but only in a way that our users are de-identified,. For example, we may share demographic data that describes the percentage of Subscribers who use mobile services or who use a particular operating system. We or our third-party vendors may publicly report the aggregated findings of the research or analysis, but only in a de-identified manner.
With Third Parties Involved in Legal Requests or Accounting, Legal, or Security Services. We may share any or all Personal Information with courts, law enforcement agencies, or other government bodies when we believe we are required to do so by law, including to meet national security or law enforcement requirements, to protect the interests of our company, or to respond to a court order, subpoena, search warrant, or other law enforcement request. We will share Personal Information as necessary to providing information to our representatives and advisor (e.g., accountants and attorneys) to help us comply with legal, accounting, and security requirements We may share Personal Information as necessary or appropriate to bring or pursue a claim or counterclaim to enforce this Privacy Policy, the Terms of Use, any agreement with a Subscriber, or to otherwise protect or defend any of our interests.
With Credit Bureaus. We may share Personal Information of Subscribers with credit bureaus, consumer reporting agencies, card associations, and investigatory bodies. Late payments, missed payments, or other defaults on a Subscriber’s account may be reflected in D&B report.
With a Prospective or Actual Purchaser of Our Business. If we become interested in selling, merging, or transferring any part of our business, Personal Information may be shared with the potential purchaser or transferred to the successor or purchaser, as the case may be. We shall de-identify Personal Information shared with prospective purchasers.
Your Choices and Rights
We operate in the United States; however, servers supporting the Services or the Site may be located outside of the United States.
Generally. YOUR RIGHTS AND CHOICES CONCERNING PERSONAL INFORMATION THAT WE HAVE COLLECTED ABOUT YOU WILL DEPEND ON APPLICABLE LAW AND WHETHER YOU ARE A SUBSCRIBER, AN ADMINISTRATOR, OR A SUBSCRIBER’S AUTHORIZED USER. UNDER CALIFORNIA LAW, YOU MAY HAVE THE RIGHT TO REQUEST IN WRITING FROM US A LIST OF THE CATEGORIES OF PERSONAL INFORMATION THAT WE HAVE DISCLOSED TO THIRD PARTIES, AND THE NAMES AND ADDRESSES OF ALL SUCH PARTIES. IF YOU ARE LOCATED OUTSIDE OF THE UNITED STATES, YOU MAY HAVE THE RIGHT TO OBJECT TO PROCESSING OF YOUR PERSONAL INFORMATION, ASK US TO RESTRICT PROCESSING YOUR PERSONAL INFORMATION, OR REQUEST PORTABILITY OF YOUR PERSONAL INFORMATION. Marketing Communications from Us. If marketing communications are received from us that are not wanted, click the "unsubscribe" link in the email received. Even if marketing communications are terminated, we will continue to send mandatory service or transactional communications.
Updating Personal Information. Only account, login, and payment information can be changed. Our customer support can be reached by using the contact information provided in the "How to Contact Us" below. Any Personal Information contained in a communication shared with the applicable Subscriber or administrator cannot be changed as it is part of our archives once created. Deletion of any such records is determined by our retention policies.
Cookies and Similar Tracking Technologies. The following is a high-level summary of our practices and controls for cookies and other tracking technologies. For more information, please see our Cookies Policy in the next section.
In accordance with applicable law, we and our service providers may use commonly-used tools to recognize Users and track interactions with our Services such as cookies, web beacons, and similar technologies (collectively, "Cookies"). Accepting cookies improves the quality of your experience. Other times, we combine data collected from Cookies with that of other Subscribers or Users to improve our customers' experience. Information on changing browser settings to opt out of Cookies can be found in a device’s browser settings.
We make use of certain third-party analytics providers (“TPAPs”) to, among other things, serve advertisements to the Site and Users on third-party websites across such TPAPs’ networks. We allow TPAPs to track User browsing history on the Site using first-party Cookies (such as the Google Analytics cookie) and third-party Cookies (such as the DoubleClick cookie). TPAPs may use the information stored by the Cookies to, among other things, evaluate your use of a website, prepare reports of website activities for website operators, and provide other services associated with website and Internet usage. The information tracked and stored by the Cookies enables TPAPs to optimize and serve ads to the Users on third-party websites. By using the Site, you agree to the forwarding of data to TPAPs and the processing by such TPAPs of the data collected from you in the manner and for the purposes described above.

Even if a user elects to opt-out of Cookies and interest-based advertising, he or she will still receive advertisements, but they will not be tailored to the individual’s interests. Use of new devices may require new elections to opt-out.
Do Not Track. We do not directly collect anything that would fall under “Do Not Track” other than what third parties collect and use (primarily Google and FB). While there are no standards, individual browsers allow users to turn on a “Do Not Track” feature; however, it is not always clear what standard those browsers apply.
Social Media Features. The Services may use social media features, such as Facebook sharing ("Social Media Features"). These features may collect IP address and which page an individual is visiting within our Services and may set a cookie to enable the feature to function properly. Social Media Features are either hosted by a third party or hosted directly on our Services. Interactions with these features are governed by the privacy statement of the company providing the relevant Social Media Features.
Other Important Information
Security. We take precautions to protect Personal Information and other sensitive information. The Site uses industry standard encryption to protect your data in transit. This is commonly referred to as transport layer security (“TLS”) or secure socket layer (“SSL”) technology. The Site is in compliance with PCI vulnerability standards in order to create as secure of an environment as possible for Users.
We undertake commercially reasonable efforts to update our security practices to implement accepted best methods to protect Personal Information and other sensitive information, and we review our security procedures carefully. We also use commercially reasonable efforts to comply with applicable laws and security standards to securely transmit Personal Information, train our staff and require them to safeguard Personal Information and sensitive information, and transmit, store, protect, and access all cardholder information in compliance with the Payment Card Industry's Data Security Standards. Only employees, contractors, representatives, and agents who need the information to perform a specific job (for example, billing or customer service) are granted access to Personal Information. We required that the computers/servers in which we store Personal Information are kept in a secure environment.
Cookies. We may "cookies" on the Site. A cookie is a piece of data stored on the Site’s system to help us improve access to the Site and identify repeat Users. (Users' web browsers place cookies on their hard drives.) For instance, we may use a cookie to identify a User so that he or she does not have to log in a password more than once, thereby saving time while on the Site. We also use cookies to distinguish User accounts for security and privacy reasons, and to conduct marketing campaigns that we think may interest certain Users. For these reasons, enabling cookies is mandatory for full functionality of our Site and service. Cookies can also enable us to track and target the interests of Users to enhance the experience of the Services. Usage of a Cookie is in no way linked to any Personal Information.
Links. The Site contains links to other websites. We are not responsible for the content, terms of use, or privacy practices of other websites or third parties. We encourage our Users to read the privacy statements of all websites.
Updates to this Privacy Policy. Our Privacy Policy may change from time to time and all updates will be posted on this page. If we are not abiding by this Privacy Policy, contact us immediately. See “How To Contact Us” below.
Changes to Privacy Practices. From time to time we may change or update our privacy practices. We reserve the right to make changes or updates at any time. If we make material changes to the way we handle Personal Information, we will provide notice via our Service or by other communication channels, such as by email or community post. Please review any changes carefully. If a Subscriber objects to any of the changes and no longer wishes to use our Services, its account may be closed. All changes are effective immediately upon posting and any use of our Service after a notice of material change or posting of an updated Privacy Policy shall constitute consent to all changes.
Collection and Use Of Children's Personal Information. Protecting the privacy of children is especially important. The Services are not directed to minors and we do not knowingly collect Personal Information from minors. If you become aware of a User who is under the age of 13 years of age, please contact us with full details. If you have been reported as being under 13, and we determine that the report has merit, we will request that you provide proof of age with a copy of government identification, and will discontinue providing our service if you do not comply.
California Shine the Light Law. We do not share any individual’s Personal Information with third parties for their marketing purposes without the individual’s consent.
